PROJECT: Draft Borough Tall Structures Ordinance
The Matanuska-Susitna Borough is in the process of revising existing borough regulations for telecommunications towers, wind energy conversion systems, and other tall structures. The existing regulations are being updated in order to increase compliance with federal regulations, clarify the permitting processes for tall structures, and better protect the health, safety, and general welfare of the public.
The links above will take you to  the public review draft of the proposed regulations. The updated regulations will supersede those of special land use districts relating to tall structures within the Borough, except that the height at which a conditional use permit is required by the special land use district will remain in effect. This provision is in response to a declaratory ruling by the Federal Communications Commission which limits the time in which a local zoning authority may render a decision and staffs increased awareness of the Federal Telecommunications Act of 1996.
Two administrative permit processes are being proposed which can increase tower height to allow for and encourage co-location of existing towers. The administrative processes are described in Section 17.66.050 and 17.66.070 of the draft regulations.
