MSB Platting: Cook's Castle Estates Case#2010-035

Platting Board
will consider the following:
TAMMY J COOK (petitioner / owner)

REQUEST: The request is to subdivide Tract A-5, Cook's Castle Estates, No.2 (Plat #2005-73, into three new lots and three new tracts to be known as COOK'S CASTLE ESTATES NO.2-A. The petitioner has requested a variance from MSB 27.20.065 (D)(1)&(2) Lot and Block Design, that states: For flag lots greater than five acres, the pole portion shall be overlaid with a public use easement that extends a minimum of lOO feet past the furthest point at which the pole portion connects for future subdivision of the flagged parcels. Part (D)(2) states: the minimum pole portion width is 60 feet for a single pole portion. The petitioner has requested a variance from MSB 27.20.070(A) Frontage for Tract A-5A.
Part (A) states: Lots shall contain a minimum of 60 feet frontage. Tract A-5A has an existing 50' wide flag pole bounded
by lots within Swiss Castle Estates III Phase I.
The Matanuska-Susitna Borough Platting Board will hold a public hearing on the Resubdivision with Variances beginning at 8:30 AM on August 5. 2010, in the Assembly Chambers of the Dorothy Swanda Jones Building. 350 E. Dahlia Ayenue.

If you would like to send comments regarding the proposed action, this form may be used for your convenience by filling in the information above and mailing this notice to the Matanuska-Susitna Borough, Platting Division, 350 E. Dahlia, Palmer, Alaska 99645 or Fax (907) 746-7407. Comments received by 3:00 PM one week prior to the meeting will be included in the Platting Board packet. Comments received up to 4:00 PM one day prior to the meeting will be given to the Platting Board in a "Hand Out" packet the day of the meeting. If there is not enough room above, please attach a separate piece of paper.

Please do not send comments or questions directly to the Platting Board members. Board members may not receive or engage in ex-parte contact with the applicant, other parties interested in the application, or members of the public
concerning the application or issues presented in the application.
In order to be eligible to file an appeal from a decision of the Platting Board, a person must be designated an interested party pursuant to MSB 15.39.010. An interested party means, (a) the applicant before the Platting Board; or (b) any person affected by the decision who appeared before the Platting Board and made an oral or written presentation. The procedures governing appeals to the Board of Adjustment & Appeals are contained in MSB 15.39.010-250, which is available on the Matanuska-Susitna Borough internet home page in the Borough Clerk's office, or at various libraries within the borough.
